Terms and conditions

These terms cover the use of this website and the HYEB FLEET software. They form an agreement between you (or the company you represent) and [NEEDS YOUR REGISTERED COMPANY NAME].
HYEB FLEET is sold to businesses. If you are agreeing to these terms, you are confirming that you do so on behalf of a company and that you are authorised to bind it.
What the software does
HYEB FLEET is software for running a fleet operation: inspections, work orders, service schedules, dispatch and messaging. What your subscription includes is set out in your plan or in the written quote we issued to you. Where a quote and these terms disagree, the quote wins.
What the software does not do
The software helps you record and organise your operation. It does not itself make your company compliant with any law or regulation, and we do not certify, audit or guarantee your compliance. Responsibility for meeting the rules that apply to your business — including inspection, maintenance and record-keeping obligations — remains yours.
Your account
You are responsible for the accounts you create, for keeping their passwords private, and for what is done through them. Tell us promptly if you think an account has been compromised.
Your data
Your operational data is yours. We process it to provide the service, as described in the privacy page. We do not sell it and we do not use it to advertise to you.
Paying
Subscriptions are billed in advance, monthly or annually, as chosen when the subscription starts. Prices are exclusive of any tax that applies. A one-time setup or configuration fee may apply where a quote says so; that fee will be stated in the quote before you accept it.
If a payment fails
We will tell you. There is then a grace period during which the service continues to work normally. If it is still unpaid after that, some functions are restricted — see the refund and cancellation page for exactly what changes. Your existing records remain readable, and nothing is deleted because of an unpaid invoice.
Changing your subscription
You can add users, vehicles, storage or modules at any time; the additional cost is calculated from the pricing rules in force and takes effect when it is paid. Reducing a subscription takes effect at the next renewal.
Ending it
Either of us can end the agreement. How notice works, and what happens to money already paid, is on the refund and cancellation page.
Availability
We work to keep the service running and we take backups, but we do not promise it will never be unavailable. We may take it offline for maintenance, and we will avoid doing that during normal working hours where we reasonably can.
Our responsibility
Nothing in these terms limits liability where the law does not allow it to be limited — that includes death or personal injury caused by negligence, and fraud.
Beyond that, and to the extent the law allows: we are not liable for indirect or consequential loss, for loss of profit, or for data you did not keep a copy of elsewhere; and our total liability in any twelve-month period is limited to the fees you paid us in that period.
A lawyer should look at this. the limitation above is a common shape, but the wording that is actually enforceable depends on your country. Have this clause reviewed before you rely on it.
Acceptable use
Do not use the service to break the law, to store someone else's data without the right to do so, or to attempt to compromise the service or another customer's environment.
Changes to these terms
We may update these terms. If a change materially affects you, we will tell you before it applies to your subscription.
Law and disputes
This agreement is governed by [NEEDS THE GOVERNING LAW], and disputes are for the courts of [NEEDS THE COURT FOR DISPUTES].
